1. Introduction

These Terms and Conditions ("Terms") govern your use of the ListMyHotel.ai platform ("Platform"), operated by Hotelkite Private Limited ("Company", "we", "us"), a company incorporated under the laws of India. By accessing or using the Platform, you agree to be bound by these Terms.

2. Definitions

"User" refers to any individual or entity that registers on the Platform. "Hotel" refers to any accommodation property registered through the Platform. "OTA" refers to Online Travel Agencies such as Booking.com, Airbnb, MakeMyTrip, and others. "Services" refers to the OTA registration, document management, and AI-powered onboarding services provided through the Platform.

3. Account Registration

You must provide accurate and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials. You must be at least 18 years old and have the legal authority to register the hotel property on OTA platforms. One account may manage multiple hotel properties.

4. Services

The Platform facilitates hotel registration on third-party OTA platforms. We act as an intermediary and do not guarantee acceptance by any OTA. Registration timelines are estimates and may vary based on OTA processing times and document completeness. AI-powered features (hotel data extraction, research) are provided on a best-effort basis and may not be 100% accurate.

5. Payments & Refunds

All payments are processed securely through Razorpay. Prices are displayed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. Bundle discounts are applied automatically based on the number of OTAs selected. Refunds may be issued at the Company's discretion if an OTA registration is rejected due to reasons within our control. No refunds will be issued for rejections due to incomplete or inaccurate information provided by the User.

6. User Obligations

You agree to: provide accurate hotel information and valid documents; ensure you have the legal right to register the property on OTA platforms; not upload fraudulent, misleading, or illegal content; comply with all applicable laws and OTA platform policies; keep your account credentials secure.

7. Document Handling

Documents uploaded to the Platform are stored securely on Amazon Web Services (AWS) S3 with encryption at rest. Documents are used solely for the purpose of OTA registration. We retain documents for the duration of your account plus 12 months after account deletion. You may request document deletion at any time by contacting support.

8. Intellectual Property

The Platform, including its design, code, AI models, and content, is the intellectual property of Hotelkite Private Limited. OTA logos and trademarks displayed on the Platform belong to their respective owners and are used for identification purposes only. You retain ownership of all content and documents you upload.

9. Limitation of Liability

The Company shall not be liable for: delays or rejections by OTA platforms; inaccuracies in AI-generated data; loss of business or revenue arising from use of the Platform; any indirect, incidental, or consequential damages. Our total liability shall not exceed the amount paid by you for the specific service in question.

10. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time by contacting support. Upon termination, your data will be retained for 30 days before permanent deletion.

11. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.
